Tanzania Extractive Sector Legal Framework
Mining operations across Tanzania are governed by the Mining Act, 2010, fundamentally overhauled by the Natural Wealth and Resources (Permanent Sovereignty) Act, 2017 and the Mining Commission.
1. Tanzanite Heritage Protection
Tanzanite occurs solely in an 8-square-kilometer area at Mererani in northern Tanzania. The 2017 amendments raised rough Tanzanite royalties to 6% and mandated that all raw stones pass through the Mererani perimeter wall.
2. 16% Free Carried Interest
Under Section 10 of the Mining Act, the Government of the United Republic of Tanzania holds a statutory non-dilutable 16% free equity stake in all large-scale mining operations holding Special Mining Licenses.
3. In-Country Value Addition
To incentivize domestic cutting, polishing, and lapidary industries, polished gemstones receive a drastically reduced royalty rate of 1%, contrasted with the 6% rate on raw rough exports.
4. 0.3% Local Service Levy
Mining companies must remit 0.3% of turnover to the local municipal council hosting the mine (e.g. Geita, Kahama, Simanjiro) to construct roads, health clinics, and clean water infrastructure.
