Tanzania Unfair Dismissal Legal Framework
Protections against arbitrary discharge are governed by Part III, Subpart E of the Employment and Labour Relations Act, 2004 (ELRA) and the Labour Institutions Act, 2004.
1. Fair Reason & Fair Procedure
Under Section 37, a dismissal is unfair unless the employer proves valid grounds (misconduct, incapacity, operational requirements) and adherence to a fair disciplinary hearing procedure (Rule 13 of G.N. 42/2007).
2. Section 41 Notice Pay
Notice must be given in writing, stating the reasons for termination. If an employer waives the notice period, they must tender immediate pay in lieu equal to full remuneration.
3. Section 40 Remedies
If an arbitrator finds a termination unfair, the primary remedies under the law are reinstatement without loss of remuneration, re-engagement, or compensation not exceeding 12 months' pay.
4. Constructive Dismissal
If an employee terminates employment because the employer made continued employment intolerable, Section 36(1)(c) deems it a constructive dismissal with full eligibility for CMA compensation awards.
