Tanzania Termination & Retrenchment Framework
Severance pay and termination of employment are strictly regulated under the Employment and Labour Relations Act, No. 6 of 2004 and the Employment and Labour Relations (General) Regulations, 2017.
1. ELRA Section 42 Entitlement
An employer must pay severance pay if an employment contract is terminated due to redundancy (operational requirements), incapacity, or by the employee due to intolerable employer actions.
2. 7 Days Wage per Year
The law establishes a non-negotiable statutory baseline of at least 7 days' basic wage for every completed year of service, calculated on the basic rate without discretionary allowances.
3. Section 38 Consultations
In collective redundancy scenarios, employers must issue formal notices to trade unions (TUCTA / relevant branch) and engage in mandatory consultations on alternatives to dismissal.
4. Repatriation Rights
Under Section 43, employees recruited away from their home districts are legally entitled to employer-paid transport to their place of recruitment upon lawful termination.
