Turks and Caicos Employment Ordinance Severance Rules
The Employment Ordinance (Cap 17.08) governs employment conditions, dismissal, and redundancy in the Turks and Caicos Islands:
Severance Formula (Section 42)
- Minimum Service: 2 continuous years of employment required.
- Rate: Two (2) weeks' basic pay for each completed year of continuous service.
- Statutory Maximum: Maximum severance pay is strictly capped at twenty-four (24) weeks' basic wages (achieved at 12 years of service).
- Redundancy Definition: Occurs when the employer ceases business, moves location, or reduces workforce requirements.
Notice of Termination (Section 27)
- Tenure < 1 Year: At least 2 weeks' notice.
- Tenure 1 to 5 Years: At least 1 month's notice.
- Tenure > 5 Years: At least 2 months' notice.
- Payment in Lieu: Employers may terminate immediately by paying basic wages in lieu of the statutory notice period.
