Tuvalu Employment Act (Cap. 40.28) Termination Rules
Under the Employment Act (Cap. 40.28) of Tuvalu:
- Notice of Termination: Employers must provide advance written notice (1 to 4 weeks according to continuous tenure) or pay the employee basic salary in lieu of notice.
- Redundancy Compensation: When termination occurs through no fault of the worker due to lack of business, restructuring, or project closure, severance pay of up to 2 weeks per completed year of service is awarded.
- Leave Encashment: Any accrued but unutilized annual recreation leave must be fully settled in cash upon the final working day.
