Statutory Land Transfer Process in Uganda
- Role of Chief Government Valuer (CGV): Under the Stamps Act, URA does not accept the sale price unquestioned. A Government Valuer inspects the property to determine the open market value, and stamp duty is assessed on whichever is greater.
- 1.5% Stamp Duty Rate: Stamp duty on land transfers is 1.5% under the Stamps (Amendment) Act. For mortgages registered to secure bank financing, stamp duty is 0.5%.
- Ministry of Lands (MLHUD) Requirements: Transfer forms, passport photos, National IDs (NIN), and tax clearance certificates must be submitted to the zonal land office (e.g. KCCA, Wakiso, Mukono) along with the original duplicate title.
